Terms of Service

1. Agreement to Terms

By requesting a quote, sending a project brief, or making a payment to Ethan Koda ("I", "me"), you ("the Client") agree to these Terms of Service. If you do not agree, please do not use my services.

2. Services

I provide website design and development services, including business websites, e-commerce stores, custom web applications, and maintenance & support, as described on the homepage. The exact scope of each project is defined in the written quote approved by both parties.

3. Quotes & Payment

• All prices are quoted in USD and are valid for 30 days.
• Projects begin after receipt of a 50% deposit; the remaining 50% is due on delivery, before the site goes live.
• Maintenance plans are billed monthly in advance and can be cancelled with 14 days' notice.
• Late payments may pause work and delay delivery dates.

4. Timeline & Revisions

Delivery estimates assume the Client provides content, feedback, and approvals on time. Each project includes two rounds of revisions during the design phase; additional rounds or scope changes are quoted separately.

5. Client Responsibilities

The Client confirms they own or hold licences for all text, images, and other materials provided for the project, and that these materials do not infringe any third-party rights.

6. Intellectual Property

Upon full payment, the Client owns the final delivered website code and design. I retain the right to display the completed work in my portfolio unless otherwise agreed in writing. Pre-existing tools, libraries, and frameworks remain under their original licences.

7. Warranties & Liability

I deliver work professionally and fix defects reported within 30 days of launch at no charge. To the maximum extent permitted by law, I am not liable for indirect or consequential damages, and total liability is limited to the amount paid for the project. I do not guarantee specific revenue, traffic, or search-ranking outcomes.

8. Third-Party Services

Projects may rely on third-party services (hosting, domains, Shopify, payment gateways). Their uptime, pricing, and policies are outside my control, and their fees are paid directly by the Client.

9. Termination

Either party may end a project in writing. Work completed up to that point is invoiced pro-rata; the deposit covers the first stage of work and is non-refundable once the design phase has begun.
